## Indications for Use

The stent is intended as a palliative treatment of malignant neoplasms in the biliary tree.

## Device Story

Self-expanding Nitinol stent system for permanent implantation in biliary tree; used for palliative treatment of malignant neoplasms. Stent cut from Nitinol tube in open lattice design; features tantalum radiopaque markers at proximal and distal ends. Pre-mounted on 6 Fr (2.0 mm) over-the-wire delivery system; compatible with 0.035 in guidewire. Upon deployment, stent expands to predetermined diameter, exerting constant outward force to maintain biliary patency. Operated by clinicians in clinical setting. Output is physical structural support for biliary duct; healthcare provider uses device to restore/maintain patency in obstructed biliary passages, providing symptomatic relief for patients with malignant biliary obstructions.

## Clinical Evidence

No clinical data provided; substantial equivalence is based on technological and design characteristics identical to the predicate device.

## Technological Characteristics

Nitinol (nickel titanium alloy) self-expanding stent; open lattice design; tantalum radiopaque markers. 6 Fr (2.0 mm) delivery system; 0.035 in guidewire compatibility. Permanent implant. Sterilization parameters identical to predicate.

## Regulatory Identification

A biliary catheter and accessories is a tubular flexible device used for temporary or prolonged drainage of the biliary tract, for splinting of the bile duct during healing, or for preventing stricture of the bile duct. This generic type of device may include a bile collecting bag that is attached to the biliary catheter by a connector and fastened to the patient with a strap.

## Special Controls

*Classification.* Class II (special controls). The device, when it is a bile collecting bag or a surgical biliary catheter that does not include a balloon component, is exempt from the premarket notification procedures in subpart E of part 807 of this chapter subject to the limitations in § 876.9.

Dear Kim Wallner:

We have reviewed your section 510(k) premarket notification of intent to market the device referenced above and have determined the device is substantially equivalent (for the indications for use stated in the enclosure) to legally marketed predicate devices marketed in interstate commerce prior to May 28, 1976, the enactment date of the Medical Device Amendments, or to devices that have been reclassified in accordance with the provisions of the Federal Food, Drug, and Cosmetic Act (the Act) that do not require approval of a premarket approval application (PMA). You may, therefore, market the device, subject to the general controls provisions of the Act. Although this letter refers to your product as a device, please be aware that some cleared products may instead be combination products. The 510(k) Premarket Notification Database available at https://www.accessdata.fda.gov/scripts/cdrh/cfdocs/cfpmn/pmn.cfm identifies combination product submissions. The general controls provisions of the Act include requirements for annual registration, listing of devices, good manufacturing practice, labeling, and prohibitions against misbranding and adulteration. Please note: CDRH does not evaluate information related to contract liability warranties. We remind you, however, that device labeling must be truthful and not misleading.

If your device is classified (see above) into either class II (Special Controls) or class III (PMA), it may be subject to additional controls. Existing major regulations affecting your device can be found in the Code of Federal Regulations, Title 21, Parts 800 to 898. In addition, FDA may publish further announcements concerning your device in the Federal Register.

You must comply with all the Act's requirements, including, but not limited to: registration and listing (21 CFR Part 807); labeling (21 CFR Part 801); medical device reporting (reporting of medical device-related adverse events) (21 CFR Part 803) for devices or postmarketing safety reporting (21 CFR Part 4, Subpart B) for combination products (see https://www.fda.gov/combination-products/guidance-regulatory-information/postmarketing-safety-reporting-combination-products); good manufacturing practice requirements as set forth in the Quality Management System Regulation (QMSR) (21 CFR Part 820) for devices or current good manufacturing practices (21 CFR Part 4, Subpart A) for combination products; and, if applicable, the electronic product radiation control provisions (Sections 531-542 of the Act); 21 CFR Parts 1000-1050.

All medical devices, including Class I and unclassified devices and combination product device constituent parts are required to be in compliance with the final Unique Device Identification System rule ("UDI Rule"). The UDI Rule requires, among other things, that a device bear a unique device identifier (UDI) on its label and package (21 CFR 801.20(a)) unless an exception or alternative applies (21 CFR 801.20(b)) and that the dates on the device label be formatted in accordance with 21 CFR 801.18. The UDI Rule (21 CFR 830.300(a) and 830.320(b)) also requires that certain information be submitted to the Global Unique Device Identification Database (GUDID) (21 CFR Part 830 Subpart E). For additional information on these requirements, please see the UDI System webpage at https://www.fda.gov/medical-devices/device-advice-comprehensive-regulatory-assistance/unique-device-identification-system-udi-system.

Also, please note the regulation entitled, "Misbranding by reference to premarket notification" (21 CFR 807.97). ## Device Description

The Protégé EverFlex self-expanding peripheral stent system is a self-expanding Nitinol stent system intended for permanent implantation.

The self-expanding stent is made of a nickel titanium alloy (Nitinol) and comes pre-mounted on a 6 Fr (2.0 mm), 0.035 in (0.89 mm) over-the-wire delivery system. The stent system is compatible with a 0.035 in (0.89 mm) guidewire. The stent is cut from a Nitinol tube in an open lattice design and has tantalum radiopaque markers at the proximal and distal ends of the stent. Upon deployment, the stent achieves its predetermined diameter and exerts a constant, gentle outward force to establish patency.

## Indications for Use

The stent is intended as a palliative treatment of malignant neoplasms in the biliary tree.

## Substantial Equivalence

The indication for use, intended use, principles of operation, and fundamental scientific technology of the subject device, Protégé EverFlex self-expanding peripheral stent system, were found to be substantially equivalent to the predicate device, Protégé EverFlex self-expanding biliary stent system (K060057 and K072301).

A comparison of the Protégé EverFlex self-expanding peripheral stent system to the predicate device indicates the following similarities:

- Same operating principle
- Same technological, engineering, and performance characteristics
- Same design features
- Same sterilization requirements, methods, and parameters
- Same shelf-life
- Same materials of construction
- Same packaging materials

The differences between the predicate device and the subject device are limited to the labeling. The following modifications were made:

- Addition of the following contraindication “Patients with known hypersensitivity to nickel titanium” to the IFU
- The product name is being updated from “Protégé™ EverFlex™ Self-expanding Biliary Stent System” to “Protégé™ EverFlex™ Self-expanding Peripheral Stent System”

The differences have been demonstrated to be substantially equivalent to the predicate device.

## Conclusion

The information included in this submission is sufficient to demonstrate that the Protégé EverFlex self-expanding peripheral stent system with the added contraindication and modifications to device name is substantially equivalent to the predicate device, Protégé EverFlex self-expanding biliary stent system (K060057 and K072301), and do not raise new questions of safety or effectiveness.
